At 9 a.m. Chicago Police will have a press briefing on the case before Smollett appears in court.
The police said that the actor who stars on Fox’s Empire was taken into custody around 5 a.m. CT.
Smollett faces a felony charge of disorderly conduct for allegedly filing a false report. The R&B singer claimed that he was attacked by two masked assailants on Jan. 29 in Chicago.
He stated that the two alleged attackers called him racist and homophobic slurs, poured bleach on him, and tied a noose around his neck.
When Smollett initially reported the alleged incident, the Chicago Police Department treated it as a hate crime.
Filing a false police report in Illinois is punishable by one to three years.
